Wiimm and Leseratte are native German developers, and their server is hosted in Germany. German law makes Wiimmfi LEGAL as long as the real servers are shut down, which they are. Nintendo could get upset about this, but they don't have the legal permission to do anything about it anymore.

TL;DR You don't have to worry about getting in trouble when using these servers. Wiimmfi Forums also would not allow this at all if it were illegal.
